1.1 These General Online Sales Conditions, in conjunction with the order form and other elements specified therein, regulate the terms and conditions of the provision of the Online Shop of Quinta Nova Nossa Senhora do Carmo SA, that has its registered office at Quinta Nova, 5085-222 Covas do Douro, with single registration and corporate body number 502 702 923, and share capital of €1,496,394, hereinafter called QUINTA NOVA.
1.2 The purchase of any product from QUINTA NOVA’s Online Shop implies acceptance of these General Online Sales Conditions.
1.3 Any and all alcoholic beverages available for sale in QUINTA NOVA’s Online Shop can only be purchased by persons who are of legal drinking age in their country of residence.
2. Information on Products, Prices and Content
2.1 QUINTA NOVA reserves the right to modify, without prior notice and at any time, the information and commercial offer presented, in relation to products, prices, special offers, commercial terms and services.
2.2 The images that illustrate each product in QUINTA NOVA may differ from the product that is subsequently delivered, and products may run out of stock.
2.3 Under Portuguese law, all prices shown in QUINTA NOVA include the corresponding legally prevailing VAT rates, unless otherwise stated (by means of written information: “Without VAT” always visible and next to the price).
2.5 The special offers published in QUINTA NOVA’s Online Shop may not be available in QUINTA NOVA’s physical shops.
2.6 QUINTA NOVA also informs that the online shop is na e-commerce platform meant to supply the final consummer and reservando-se o direito de limitar o stock de venda de alguns artigos por cliente.
3. Orders and Payment
3.1 After an order is confirmed with QUINTA NOVA, an email will be sent to the contact address registered by the customer at the time of the account registration, specifying all the delivery and billing details, payment information, products and amounts. QUINTA NOVA suggests that all customers confirm these details. If a customer does not receive an order confirmation email, he or she should contact QUINTA NOVA via the contacts specified below.
3.2 If any of the details provided by the customer when making the order is found to be wrong and / or the customer wants to change any information, as long as the order has not yet been dispatched, the customer should contact QUINTA NOVA as soon as possible via the contacts specified below, in order to make the alteration requested by the customer internally. Changes to the details of any orders that have already been dispatched will have to be analysed by QUINTA NOVA’s team so that, together with the customer, a more appropriate solution may be found.
3.3 All orders made to QUINTA NOVA will only be processed after full payment is received. Formalisation of the order does not, in its own right, constitute reservation of the products.
3.4 If an order cannot be fulfilled, in part or in full, the customer will be immediately contacted by QUINTA NOVA, in order to find the most suitable solution.
3.5 Orders may be cancelled when this is expressly requested by the customer through one of the contacts provided below, before the orders are dispatched. After confirmation of dispatch of the order, the customer should contact QUINTA NOVA so that, in conjunction with the latter, the most appropriate solution may be found.
3.6 In QUINTA NOVA’s Online Shop, payments are accepted via a Multibanco (ATM) Reference, Bank Transfer or Paypal.
3.7 The status of orders at QUINTA NOVA encompass 3 stages: Pending, In Processing and Completed.
- a) Pending - Waiting for payment to enter QUINTA NOVA’s system;
- b) In Processing – The stage when the payment has already been received, and the order is being processed and in packaging / preparation;
- c) On Hold - Awaiting additional confirmation from the customer to proceed with the order. Exceptional stage.
- d) Completed - The order has already been dispatched / sent.
3.8 Payments shall be received in euros, regardless of the currency in which the transaction is made, all conversion charges for payments made in other currencies shall be borne by the customer.
4. Delivery costs
4.1 In addition to the prices specified for the products, the respective delivery costs shall be added to each order, calculated as the sum of two factors: the packaging cost and the transport cost. The delivery cost depends on the weight and delivery destination of the order. The total postage will be automatically calculated when the customer places an order in the Online Shop. Please note that the factors considered in this calculation may vary and may change without notice.
5. Dispatches and Deliveries/h3>
5.1 For orders to be sent to the requested address, the customer must indicate the respective transportation option - National Transportation (in the case of Portugal) or International Transportation (outside Portugal). The order will always be dispatched with the respective waybill; The customer should take into account the fact that transportation times are estimated times, if the transportation company tries to make a delivery and the customer is not at home at the scheduled time, the transportation time may change.
5.2 As a general rule, the transportation times after dispatch of orders from QUINTA NOVA are:
. Between 48 hours to 96 hours for Mainland Portugal
. Between 4 to 15 working days for the rest of Europe
NOTE: QUINTA NOVA sends orders to the following countries: Portugal, Spain, Austria, Belgium, France, Germany, Italy, Luxembourg, Monaco, Netherlands, United Kingdom, Denmark, Finland, Greece, Ireland, Norway, Sweden, Switzerland*, Andorra, Croatia, Cyprus, Czech Republic, Estonia, Gibraltar, Hungary, Latvia, Liechtenstein, Lithuania, Poland, Serbia, Slovakia, Slovenia, Turkey, Ukraine
*The shipping for Switzerland is limited up to 12 bottles per order and per client.
. If the country for which you want to place your order is not on our list, please contact us via e-mail at quintanovawinetourism@amorimfamilyestates.com, so that we can evaluate the possibility of sending the order.
5.3 The customer will receive a notification email with confirmation of dispatch of the order as soon as it is processed, which will specify a link and tracking number to be able to track the dispatch. Orders are executed on a first-come, first-served basis, and are only dispatched after confirmation of payment; If for any reason the customer does not receive the transportation confirmation, he or she should contact QUINTA NOVA through one of the contacts listed below, and all available transportation information for the order will be resent.
5.4 After notification of dispatch, clients should follow and track the state of the order through the link provided by the hired delivery Company, since QUINTA NOVA does not notify the client of any change or delay on the delivery of the order.
5.5 All products sent by QUINTA NOVA must be checked upon delivery. If the customer finds that the order is damaged, he or she must immediately return it to the transportation company, and provide due justification for this return, on the transportation company's delivery note, and immediately notify QUINTA NOVA via one of the contacts listed below.
5.6 If, after delivery, the customer finds that any of the items is not in conformity, he or she must immediately contact QUINTA NOVA via e-mail quintanovawinetourism@amorimfamilyestates.com indicating the order number, or the number of the order’s accompanying document, attaching images of the packaging as received and images of all items, so that the investigation process of the occurrence may be opened internally and the situation may be resolved as quickly as possible.
5.7 QUINTA NOVA is not responsible for dispatches made to countries where the respective law does not permit importation of alcoholic beverages. The customers shall be solely liable for any confiscation of the respective orders, as well payment of any customs duties. In the event that products are returned, QUINTA NOVA shall only refund the amount corresponding to the respective products. In the event of any doubt, customers may contact QUINTA NOVA before placing an order.
5.8 QUINTA NOVA has contracted services with specialised transportation companies for making deliveries in Portugal, Europe and most countries around the world. Every effort is made to comply with transportation and delivery deadlines, however it should be noted that possible delivery delays may be beyond the control of QUINTA NOVA, and in these cases, it is not possible to guarantee exact transportation times.
5.9 Most deliveries shall be made during normal business hours on working days, to the transportation address indicated by the customer when the order was placed.
5.10 In the event of an unsuccessful delivery attempt by the transportation company due to absence, an attempted delivery notification shall be left in the customer's mailbox, with the transportation company's instructions. Depending on the service and the transportation company, orders must be collected at the location indicated by the latter in the attempted delivery notification, or the indications specified in this notification must be followed.
5.11 If for any reason the customer is unable to receive the order, or cannot pick it up at the location indicated by the transportation company, he or she should contact QUINTA NOVA so that they can jointly find the most suitable solution.
6. Applicable legislation
6.1 QUINTA NOVA recognises that all its customers are entitled to terminate the contracts they enter into, and may return, within 14 (fourteen) days, the products purchased under the terms of Portuguese legislation for distance and off-premises contracts (Decree-Law no. 24/2014, of February 14, amended by Law no. 47/2014, of July 28 and Decree-Law no. 78/2018 of October 15).
6.2 To exchange or return any item, the customer must contact QUINTA NOVA via e-mail quintanovawinetourism@amorimfamilyestates.com indicating the order or accompanying document number, taking into account the conditions described below, in the following topics:
- a) In order to return the order, the product must be in perfect condition and, if applicable, with its original packaging, accessories or special offers included, accompanied by proof of purchase or the invoice.
- b) The return of defective products and erroneous dispatches is permitted, wherein QUINTA NOVA shall be liable for the respective transportation and collection costs, whenever the customer communicates this fact within 14 (fourteen) days from the date of receipt of the product.
- c) Once the goods are received at our premises and after validating their status in conformity, the full amount shall be returned, in accordance with the payment method used by the customer, or another solution previously agreed with the latter.
6.3 QUINTA NOVA assumes liability for any defects of origin or raw material of the purchased product and if confirmed by QUINTA NOVA’s specialised team, the product will be exchanged or returned without any cost to the customer.
6.4 QUINTA NOVA will not accept the return of a product after it has been used, or if it has been altered or modified.
6.5 QUINTA NOVA is not liable for any deficiencies resulting from incorrect use, negligence, poor storage conditions or force majeure events.
7. Applicable legislation
7.1 All purchases made on QUINTA NOVA’s Online Shop website are subject to Portuguese law. Any conflict or divergence in the interpretation of the General Online Sales Conditions will be submitted to the competent Portuguese Court.
7.2 If the Client is located outside mainland Portugal, QUINTA NOVA hereby states that any legal proceedings shall be submitted exclusively to Portuguese Courts.
These general sales conditions of QUINTA NOVA’s Online Shop may be changed without any prior notice, and should therefore be consulted before placing any order.
